    History of Community Council:    
      The Utah State Legislature first authorized school community councils (SCCs) in 1992.  The councils, sometimes referred to as "site based councils," were established to address the academic needs of students being made at the most local level. To help in addressing the finances needed to address the academic needs of students the Legislature established the School LAND Trust Program.  In 2002 the Legislature restructured the membership of school community councils and made the responsible for approving the School LAND Trust Plans, which became an academic subset of the school improvement plan.  The new legislation provided additional responsibilities including the development of a reading achievement plan in elementary schools, a child access routing plan for all but high schools, and directed councils to assist in the creation of a professional development plan .  School community councils were charged to develop plans and became authorized advisory groups to school and district administrators and local school boards.  Parents were granted a majority voice on the council, elected by parents of students attending the school.  The staff elected staff members, and the principal was authorized to serve as a voting member.
     
      Duties of the Council:  (Training Page)  
    • The SCC reviews U-PASS data and other information to determine the needs of students. 53A-1a-108.5(1)
    • The SCC develops a school improvement plan (SIP). 53A-1a-108 (3)(a)(i)
    • The SCC develops and submits the online School Land Trust Plan, an academic subset of the SIP. 53A-1a-108 (3)(a)(ii)
    • The SCC assists in creation of a professional development plan. 53A-1a-108 (3)(a)(iii)
    • If the school is an elementary, the SCC develops a reading achievement plan. 53A-1a-108 (3)(b)
    • The SCC may develop a child access routing plans for all elementary, middle and high schools. 53A-1a-108 (3)(a)(iv)
    • The SCC submits an required reports to the local school board for it approval. 53A-1a-108.5(5), 53A-16-101.5(6)(a)(i), 53A-3-701(3), 53A-1-606.5(4).
    • The SCC appoints subcommittees or task forces as needed. 53A-1a-108(6)
    • The SCC advises school and district administration, and the local school board, on local and district school issues. 53A-1a-108(3)(v)
    • When requested by the local school board, the SCC provides information to assist the local board in resolving issues of local concern.  The SCC is encouraged to advise and inform the local school board members. R277-491-6F and G
    • The SCC provides ongoing support in the implementation of approved plans. 53A-1a-108.5(7), 53A-16-101.5(6), 53A-3-701(1), 53A-1-606.5(3).
    • The SCC assumes other tasks and responsibilities relating to its school, such as safety, school climate, student and teacher recognition, and other issues for which it is well suited. 

    Elections

    • Notice of Elections: Notice of Elections and the positions available will be advertised the first week of August. 
    • Applications may be downloaded at the "Community Council Application" link to the left. A hard copy may be obtained at the main office of any school. 
    • Applications may be turned in anytime during the school year and kept on file for the next election. Applications should be handed in prior to the first week of August. However, the deadline for applications is two weeks prior to the election. 
    • The election will begin the day after Labor Day and continue for three consecutive days. 
    • Results of the election will be made public on the Friday of Labor Day week.


    Rules and Procedures

    To promote ethical behavior and civil discourse each council member shall:

    • Attend council meetings on time and prepared
    • Make decisions with the needs of students as the main objective
    • Listen to and value diverse opinions
    • Be sure the opinions of those you represent are included in discussions
    • Expect accountability and be prepared to be accountable
    • Act with integrity

     

    Rules of Procedure:

    All meetings are open to the public and the public is welcome to attend.

    The agenda of each upcoming meeting with draft minutes of the prior meeting will be made available to all council members at least one week in advance.

    Minutes will be kept of all meetings, prepared in draft format for approval at the next scheduled meeting.

    The council will prepare a timeline for the school year that includes due dates for all required reporting and other activities/tasks that the council agrees to assume or participate in.  The timeline will assist in preparation of agendas to be sure the council accomplishes their work in a timely manner.

    The chair or a co-chair conducts the meetings, makes assignments and requests reports on assignments.  In the absence of the chair or co-chair, the vice-chair or other co-chair shall conduct meetings.

    Meetings shall be conducted and action taken according to very simplified rules of parliamentary procedure as required in 53A-1a-108.1(9)(i).  Items on the agenda take priority over other discussions coming before the council.  Action of the council will be taken by motions and voting.  The motions and voting are recorded in the minutes.

    A motion (or an action to be taken by the council) is stated as a motion.  Someone else on the council “seconds” the motion indicating that at least one other person on the council feels the motion is worthy of discussion.  Then the council members may provide input and discussion as called upon by the chair.  When discussion seems complete the chair may call for a vote on the motion.  Or when a member of the council “calls the previous question” (a motion to end discussion of the first motion), a second is required and then, without discussion the chair calls for a vote that must pass by 2/3.  If the vote on the previous question fails the council goes back to discussing the first motion.  If the motion to call the previous question passes, the chair directly calls for a vote on the first motion.  A vote to call the previous question is usually used to move business along.

    Attached is a chart that could be used if the council feels they would like to use additional motions of Parliamentary Procedure in their meetings. 

    Simple Motions of Parliamentary Procedure 

     

      

     

    • A tie vote is a lost vote.
    • A main motion may be amended.
    • Nominations can be closed by saying, “I move to close nominations.”
    • Most motions are main motions.
    • A point of order is offered when there is some question if procedure had been followed correctly.
    • To stop debate or discussion on a motion and force the vote a member would say, “I move the previous question.”  This requires a second and a 2/3 vote.
    • Hasty action may be corrected by use of the motion to reconsider. This motion may be made only by one who voted on the prevailing side.
    • A person who made the motion may withdraw the same motion.

    2014 Law Changes

     Each school will outline and adopt a timeline for the election of council members at their school in consultation with the local school board. There are no changes to the requirements but there is a new due date of October 20th by which the following must be completed: 

    • The council must be in place, including elections and subsequent appointments. 
    • The council must have met to complete the fall noticing requirements on the school website. 
    • The Membership Form, Principal Assurance Form and Final Report on the 2013-2014 plan implementation must be submitted on the School LAND Trust website.
